Terms of Service
These Terms are an agreement between you and Patrick Booth PA (“we”, “us”) for Escape the Avalanche Deux, the original Escape the Avalanche, and this website (together, the “Game”). By playing, you agree to them. If you are under 18, please read them with a parent or guardian.
1. Playing the Game
You can play as a guest without giving any personal information. We give you a personal, non-transferable licence to play the Game for fun on devices you own or control. The Game, its art, music and code belong to us or our licensors.
Mushy the Martian. Mushy the Martian and related characters, names and artwork are owned by Ray Amanat and are used in the Game with his permission. Patrick Booth PA claims no ownership of Mushy the Martian or related characters.
2. Usernames
On first launch you choose a username. Usernames must be 3–16 letters, numbers or underscores and must be friendly: no bad words, bullying, hate, personal information or pretending to be someone else. Our filter blocks many inappropriate names, and we may rename or remove a username that breaks these rules.
3. Optional accounts
You can add an account with an email address (sign-in by a 6-digit code), Sign in with Apple, or Sign in with Google, so your progress can move with you to a new device. Accounts are only for players aged 13 or older; by creating an account you confirm you are 13 or older. Players under 13 can still play as a guest, with no account and no personal information. Keep access to your email or Apple/Google account safe; anyone who can read your sign-in codes can sign in as you.
4. Points, scores and unlocks
Lifetime points, scores, achievements and unlocks are part of the game and have no money value. They can’t be sold or traded. To keep things fair, a single run counts for at most 20,000 points, and we may remove scores or points that come from cheating, bugs or tampering. Leaderboards show usernames and scores of players with accounts.
5. Fair play
Please don’t cheat, hack, modify the Game or its traffic, overload our servers, or use bots. We may limit or close access for anyone who does.
6. Safety
The Game uses tilt and motion controls. Play somewhere safe, hold your device securely, and don’t play while walking, driving or anywhere a distraction could hurt you or others. We are not responsible for dropped or damaged devices.
7. Deleting your account
You can delete your account at any time in Options → Account → Delete Account, or by asking us (see Delete Account). This permanently deletes your account and its data, including lifetime points and unlocks, and frees your username. Guest usernames without an account are removed after 12 months without activity.
8. Changes and availability
We may update, change or stop parts of the Game (including online features like leaderboards) at any time. If we change these Terms we will update the date above; continuing to play means you accept the new Terms.
9. No warranty; limitation of liability
The Game is provided “as is” without warranties of any kind. To the fullest extent allowed by law, we are not liable for indirect, incidental or consequential damages, or for loss of data or devices. Our total liability for any claim is limited to the greater of what you paid for the Game in the 12 months before the claim or USD $10. Some places don’t allow these limits, so they may not fully apply to you.
10. Governing law
These Terms are governed by the laws of the State of Florida, USA. Before any formal dispute, please contact us so we can try to fix the problem. Any dispute will be resolved individually (not as a class action), by binding arbitration under the American Arbitration Association’s Consumer Arbitration Rules or in small claims court in Pasco County, Florida.
11. App stores
If you got the Game from the Apple App Store or Google Play, their terms also apply. Apple and Google are not responsible for the Game or its support.
